The HOA calls its resort-style pool the community's main swimming pool. Homeowners register household members and guests for pool access through the HOA's ACCESS system, and the association has held an adult night there. Under the recorded covenants the Association maintains the Common Area and may charge owners individually for pool or gate keys and fobs, though the covenants don't say in so many words that the pool is Common Area.

Architectural review for backyard pools

Homeowners' own pools fall under the same documents. The covenants say no pool, spa or other water feature may go on a lot without the Architectural Reviewer's prior written approval, and they ban above-ground swimming pools on every lot. The state's public-pool rules leave out backyard pools: the Department of State Health Services defines a residential pool as one for no more than two resident families and their guests, such as a pool serving a single-family home or duplex. A pool run by a property owners association is different. The rules put it in Class C, limited to members and their guests rather than the general public, and that makes it a public pool.

For work on an existing public pool, the state lets a minor addition, alteration, renovation or repair follow the construction standard that was in place when the pool was built. The rules date a pool by the day its building permit was issued or, where no permit was required, by when excavation or electrical service began, whichever came first. The Health and Safety Code adds that a pool which complied with state law on August 31, 2021 may keep being used, maintained and repaired under the law that applied then.

Its November 2024 drought plan sets the pool rules. In Stage 2, pools, wading pools and Jacuzzi-type pools may be filled, refilled or topped up only on designated watering days, from midnight to 10 a.m. and from 8 p.m. to midnight; in Stage 4, filling, refilling or adding water to them is prohibited. Travis Ranch has no city government of its own. Texas law lets a county or a city require a permit to operate a public pool, inspect it, charge a reasonable fee and close it for breaking the state pool law or local permit rules, and public-pool safety is shared among the state's Environmental Health Program, local health departments and local code offices. Kaufman County's Development Services department, set up in October 2018, handles most permitting in the county's unincorporated areas, and a county floodplain permit is needed for development on land FEMA maps as floodplain. We found no Kaufman County pool rule on the county pages we read, so the board should ask the County and the state health department what applies before the pool is drained.

Can a Travis Ranch homeowner appeal an ACC denial?

Texas law gives owners that right in a property owners association with more than 40 lots, once the developer no longer controls the architectural committee.
