Which pools count as commercial pools in Texas
The pool code draws the line by who swims. A residential pool serves one household and its guests; every other pool is a public pool, and the code's Class C "semi-public" pool is one run solely with lodgings such as hotels, motels, apartments or condominiums.
Class B and Class C pools under the state rules
Texas sorts pools the same way in its public pool rules, 25 Texas Administrative Code Chapter 265, Subchapter L, in force in their current form since April 26, 2024. A Class B pool is open to the general public, with or without a fee. A Class C pool is limited to occupants, members or students and their guests, and is run with lodging, youth camps, property owner associations, private organizations or clubs, or schools. A pool serving only a single-family home or duplex falls outside those rules altogether.
HOA, apartment and community pools
Federal law reaches the same pools: its definition of a public pool and spa takes in pools open only to residents of an apartment complex, a residential real estate development or another multi-family residential area. Finish color, slip resistance and markings on a public pool
Color is the first place a commercial job differs from a backyard one. Outside residential pools, the 2021 code bars interior colors, patterns or finishes that obscure objects or surfaces in the water and sets a floor of 6.5 on the Munsell color value scale, a measure of lightness; lane markings, step and bench edge markings, waterline tile, pools shallower than 24 inches and approved features such as rock formations are exempt. The CDC's model code, voluntary guidance rather than Texas law, asks for white or light pastel floors and walls so that a swimmer on the bottom, algae, dirt and cracks in the finish can all be seen from the deck.
Choosing a finish for a commercial pool
Finish makers write their warranties differently for commercial pools. SGM sells a Diamond Brite Commercial White with an extended warranty of 10 years residential and 10 years commercial, against 10 and 5 for its other Diamond Brite colors, and Wet Edge gives its Primera Stone line 15 years residential but 7 commercial. Slip resistance on steps, benches and ledges
Surfaces in public pools and spas that people stand on must be slip resistant and must not cause injury in normal use, the code says. On public pool stairs the code outlines the leading horizontal and vertical edges of every tread with slip-resistant contrasting tile or another permanent marking 1 to 2 inches wide, on treads at least 24 inches wide. Rockwall's own amendment to the code adds a stripe at least 1 inch wide along the leading edge of each swimout and underwater seat or bench step, in a permanent, slip-resistant contrasting color, to avoid conflict with the state's public pool rules.
Depth markers and the slope line
Texas requires at least two depth markers on every public pool, set in the top 4½ inches of the wall under the coping, with 4-inch figures no more than 25 feet apart, and a Class B or Class C pool deeper than 5 feet needs a permanent contrasting line where the floor breaks from shallow to deep, such as a row of floor tile at least 4 inches wide. The public pool ordinance the City publishes, Ordinance No. 03-18, applies to every non-residential pool and spa. Nobody may build or remodel one without a building permit and City plan review, and a newly built or remodeled pool gets at least one pre-opening inspection before anyone swims. The ordinance counts replacing or modifying a pool's structure, circulation system or fittings as a remodel but leaves out "normal maintenance and repair", and the City hasn't said which side of that line a replaster falls on, so ask the Building Inspections Department before the drain-down.
The City's operating permit and fees
Under the same ordinance, a public pool needs a City health permit to operate, valid for one year, and a registered Certified Pool Operator employed at all times. The application, filed with Neighborhood Improvement Services at 385 S. Goliad St., asks for the management company, the pool company, the operator's certification, whether the pump has a safety vacuum release system, and each suction cover's type, certification number and installation and expiry dates. The City's fee schedule lists $225.00 for an operator permit and for each additional pool, $25.00 for a free-standing spa, $150.00 for plan review and a $50.00 temporary closure fee; it puts a second re-inspection at $75.00 while the application form shows $50.00, so confirm that one with the City.
Closing for the work and reopening
A pool closed for 30 days or longer can't reopen without a pre-opening inspection under the ordinance, which carries fines of up to $2,000 for violations. While work goes on, Texas requires the gate of a closed Class A or Class B pool to stay locked, and apartment and HOA pools follow the separate enclosure rules of Health and Safety Code Chapter 757.
State rules for work on an existing pool
Under the state rules, a minor addition, alteration, renovation or repair may still follow the construction standard in place when the pool was built, and a pool that complied with state law on August 31, 2021 may keep being used, maintained and repaired under the law that applied then. Rockwall County runs no health department of its own, so outside the city the Texas Department of State Health Services' Region 2/3 serves the county and takes public pool complaints.

Under the federal Virginia Graeme Baker Pool and Spa Safety Act, in effect since December 19, 2008, every public pool must have drain covers and anti-entrapment systems meeting the ASME/ANSI A112.19.8 standard or its successor, and one with a single main drain that can be blocked needs at least one more system, such as a safety vacuum release, a suction-limiting vent or an automatic pump shut-off. Texas adds that a public pool's pump must not run if a drain grate, suction outlet or cover is missing, broken or loose, and the pool closes until it is fixed.
Drain covers past their date
In its April 1, 2024 reminder letter, the U.S. Consumer Product Safety Commission says public pools, apartment complexes included, need ANSI/APSP-16 2017-compliant covers, and recommends replacing any cover past the expiration date printed on it.
The deck around a public pool
The CDC's model code wants public pool decks kept to their original design slope, free of standing water and inspected daily for cracks, with surface cracks in the shell under 1/8 inch wide documented and watched for movement. The 2021 code sets deck steps at public pools with risers of 3¾ to 7½ inches and treads at least 11 inches deep, with a handrail on any run of three or more risers, and asks for 3/8 inch per foot of slope under travertine or brick-set pavers around a public pool. What is the longest lasting pool resurfacing?
In the National Plasterers Council's finish comparison, pebble rates longest, as a 12 to 18 year surface, ahead of quartz at 10 to 15 years, polished finishes at 8 to 12 and white plaster at 5 to 8. The Council ties any finish's life to proper materials, workmanship and water balance together, and at a public pool Texas requires the balance to be checked, with a method such as the Langelier Saturation Index, at least once every 10 days while the pool is open.
Does a commercial pool need a permit to be resurfaced in Rockwall?

The state inspection checklist looks for chlorine of 1.0 to 8.0 ppm, pH of 7.0 to 7.8 and cyanuric acid of 100 ppm or less, and marks combined chlorine above 0.4 ppm as a deficiency; the water must also be clear enough to see an 8-inch black disk on the floor at the deepest point.
